Victories for Trupiano Law in Family Law regarding Divorce, Annulment, Alimony, Property Distribution, Child Support, Settlement Agreements, Disputed Divorce, Protective Orders, Prenuptial and Post-Nuptial Agreements

Attorney Kim Trupiano has specialized particularly in representing people whose spouses are abusing the system to obtain more money or property than is fair from their spouse or to wrongfully exploit the children or protective orders as tools of abuse against their spouse.  Here is a list that is not all inclusive of victories that Kim Trupiano has had in family law matters:

PROPERTY MATTERS, ALIMONY, ANNULMENT, CONTEMPT, PRENUPTIAL AGREEMENTS –

Matter of S.T. – Ms. Trupiano WON dismissal of former husband’s divorce claims for ALIMONY AND WIFE’S BUSINESS INTERESTS
Husband had counter-petitioned wife in divorce proceedings for alimony and a large percentage of wife’s business, but Ms. Trupiano fought against this for years for her client until husband abandoned his claims in a final Settlement Agreement

Matter of D.D. – Ms. Trupiano drafted an EFFECTIVE PRENUPTIAL AGREEMENT that also considered immigration law and the U.S. citizen’s sponsorship of the alien spouse
Ms. Trupiano’s male client not only wanted to marry his Chilean fiancé but he also wanted to sponsor her for her legal permanent resident application through the marriage. That means he would have to financially sponsor her. If she later, within 10 years or her becoming a United States citizen, did not have sufficient funds to support herself and sought public benefits, the government would want Ms. Trupiano’s client to pay for her needs. This could even be expected of the United States citizen spouse even if the marriage in the meantime failed. So Ms. Trupiano prepared a prenuptial agreement that also imposed in the most legally enforceable way conditions on the future wife to prohibit her from using that financial sponsorship of her immigration application later as a way to obtain support from the husband unfairly.

Matter of S. – Ms. Trupiano WON against former wife’s wrongful petition against husband-client for increased PROPERTY INTEREST
Former wife sought to force husband to sell marital home quickly during which time Ms. Trupiano successfully clarified the record and original Settlement Agreement that husband would only have to pay net sales proceeds and not gross sales proceeds of sale of house to former wife. This meant that former husband will likely have to pay former wife nothing at sale of marital home unless there is the unlikely outcome that an actual profit after the original purchase price of the house is realized.

Matter of A.S. – Ms. Trupiano WON against former wife’s wrongful motion for contempt against husband regarding sale of MARITAL PROPERTY
Former wife sought contempt against former husband for not selling marital property yet. Ms. Trupiano successfully won against former wife’s claim where commissioner denied motion, finding that it was reasonable for former husband to take more time to seek to sell property. Ms. Trupiano successfully defended her client, the former husband, against former wife’s claim that Settlement Agreement should be clarified to force husband to have sold house immediately.  Ms. Trupiano also successfully argued that former wife had not met her burden of proof and the legal standards as to modifying Settlement Agreement.

Matter of E. – Ms. Trupiano SUCCESSFULLY sought ANNULMENT for husband based on fraudulent marriage with Ethiopian woman to avoid viewing PROPERTY AS MARITAL
Mr. E’s wife, who was an Ethiopian citizen who had obtained her legal permanent resident status through Mr. E and her marriage to him, sought a divorce within a year after they were together. Mr. E felt tricked and that the marriage was a ruse for her wife to obtain her legal status through him. Ms. Trupiano successfully represented in his claim for annulment based on fraud. Ms. Trupiano also worked with the immigration authorities to pursue a case against Mr. E’s former spouse for marriage fraud under immigration and federal criminal law.
