EB-5 Immigrant Investors/Employment Creation Investors
In order to be eligible for an EB-5 immigrant investor visa, a foreign national must comply with specific investment requirements:
- Invest in a new commercial enterprise: Invest $1 million into a new business that creates permanent full-time employment for at least 10 U.S. workers. The commercial enterprise must provide goods or services that benefit the U.S. economy. The individual petitioning for the investor visa must also participate in the day-to-day management of the business or serve as a business executive, such as a corporate officer.
- Invest in a troubled U.S. business: Invest $1 million into a troubled business that has incurred significant net loss (at least 20 percent of the business net worth) in the one to two years prior to investing in the business. All jobs must be maintained for at least two years. The immigrant investor must participate in the day-to-day management of the business.
- Invest in a designated Regional Center: Invest $500,000 into a new business that is affiliated with a regional center or into a troubled business that is located in a targeted employment area (as designated by the USCIS). The investment must create jobs for at least 10 U.S. workers.
